شروط الاشتراك في التطبيق
تقدم منصة آي صاغة خدمات رقمية بنظام الاشتراك من خلال تطبيق آي صاغة على متاجر التطبيقات (Google Play وApple Store).
عند الاشتراك في إحدى الخطط، فإنك توافق على ما يلي:
- الأسعار والتجديد التلقائي:
يتم تجديد الاشتراك تلقائيًا بنفس السعر والفترة ما لم يتم إلغاؤه قبل 24 ساعة على الأقل من نهاية الفترة الحالية.
يمكن للمستخدم إلغاء الاشتراك في أي وقت من خلال إعدادات حسابه في المتجر. - الفترة التجريبية المجانية (إن وجدت):
إذا اشتركت في فترة تجريبية مجانية، فسيتم تحويل الاشتراك تلقائيًا إلى اشتراك مدفوع عند انتهاء الفترة التجريبية ما لم يتم الإلغاء قبل انتهائها. - الرسوم والضرائب:
تُعرض الأسعار بالدولار الأمريكي أو بالعملة المحلية، وقد تشمل الضرائب المطبقة وفق القوانين المحلية. - إدارة الاشتراك:
يمكن للمستخدمين إدارة أو إلغاء اشتراكهم في أي وقت من خلال صفحة “الاشتراكات” في المتجر. - استرداد المبالغ:
تتم معالجة طلبات استرداد المبالغ وفق سياسات Google Play وApple Store، ولا تتم مباشرة بواسطة آي صاغة.
Mobile App Subscription Terms
iSagha provides digital subscription-based services through its mobile app available on Google Play and Apple Store.
By subscribing, you agree to the following:
- Pricing and Auto-Renewal:
Subscriptions automatically renew at the listed price and duration unless canceled at least 24 hours before the end of the current billing period.
You can cancel anytime through your Google Play or Apple Store account settings. - Free Trial (if applicable):
If you start a free trial, it will automatically convert into a paid subscription when the trial ends unless you cancel before that date. - Taxes and Fees:
Prices are displayed in USD or local currency and may include applicable taxes according to local laws. - Managing Subscriptions:
You may manage or cancel your subscription anytime in the Google Play or Apple Store “Subscriptions” page. - Refund Policy:
Refunds are handled according to Google Play and Apple Store refund policies and not directly by iSagha.
الشروط والأحكام الخاصة بعملية البيع “يداً بيد” عبر منصة آي صاغة
1. تعريف العملية
• تعمل منصة آي صاغة كوسيط معتمد ووكيل لكل من البائع والمشتري لتنفيذ عمليات البيع والشراء الخاصة بالمعادن الثمينة والمجوهرات.
• لا تعتبر آي صاغة طرفًا مباشرًا في العقد، ولا تؤول إليها ملكية السلعة أو الثمن في أي مرحلة، بل يقتصر دورها على الوساطة والتحقق وضمان إتمام العملية وفق الضوابط الشرعية والقانونية.
2. خطوات العملية
1 .يقوم المشتري بتقديم طلب شراء عبر المنصة.
2 .تستلم آي صاغة ثمن المنتج من المشتري، وتستلم المنتج من البائع إما داخل مقرها أو عبر شركات شحن معتمدة.
3 .يقوم فريق آي صاغة بالتحقق من مواصفات المنتج (النقاء، الوزن، الدمغة الرسمية أو شهادة النقاء إن وجدت).
4 .فور التحقق من مطابقة المواصفات واستلام الثمن، يتم نقل ملكية المنتج للمشتري وتحويل الثمن إلى حساب البائع، بعد خصم الرسوم المتفق عليها.
3. التحقق من المواصفات
• يتم التحقق عبر فحص بصري ووزني باستخدام أدوات معايرة معتمدة.
• لا يُجرى اختبار معملي إلا في حال الاتفاق المسبق على ذلك.
• يعتبر التحقق الذي تجريه آي صاغة نهائيًا وملزمًا للطرفين.
4. التسليم والاستلام
• يتم التسليم إما في مقر آي صاغة أو عبر شركات شحن معتمدة.
• في حال اختيار المشتري أو البائع لشركة شحن خاصة بهم، تقع المسؤولية الكاملة عليهم.
• إذا تم النقل عبر شركة شحن متعاقدة مع آي صاغة، فإن المنصة تتابع إجراءات التعويض أو حل المشكلة مع الشركة، دون التزام مالي مباشر إلا إذا ثبت خطأ جسيم من جانبها.
5. المدة الزمنية
• يتم تنفيذ العملية بالكامل خلال 24–72 ساعة عمل من تاريخ استلام آي صاغة للمنتج والثمن.
6. الرسوم والعمولات
• تتقاضى آي صاغة رسوم خدمة أو عمولة محددة مسبقًا يتم خصمها من إجمالي قيمة العملية قبل تحويل الثمن للبائع.
• يلتزم الطرفان بالاطلاع على الرسوم والموافقة عليها قبل إتمام الصفقة.
7. آلية رد الأموال
• إذا تبيّن أن المنتج غير مطابق للمواصفات المتفق عليها، تحتفظ آي صاغة بالمنتج والثمن لحين حسم النزاع.
• إذا انسحب المشتري قبل إتمام التحقق، يتم رد المبلغ المدفوع بعد خصم رسوم إدارية محددة.
• في جميع الأحوال، لا تتحمل آي صاغة أي مسؤولية عن نزاعات تنشأ خارج نطاق عملية التحقق المباشر.
8. فض النزاعات
• في حال حدوث نزاع، يتم أولًا عرضه على لجنة داخلية بآي صاغة خلال مدة لا تتجاوز 7 أيام عمل.
• إذا تعذر الحل، تكون المحاكم المصرية في القاهرة هي الجهة المختصة بنظر النزاع، مع إمكانية اللجوء إلى التحكيم التجاري إذا اتفق الطرفان.
9. الطبيعة الشرعية والقانونية
• تؤكد آي صاغة أن جميع عمليات البيع تتم وفق ضوابط البيع “يدا بيد” المتوافقة مع أحكام الشريعة الإسلامية، بما يضمن انتقال الملكية والثمن فور تحقق الشروط.
• تخضع هذه الشروط والأحكام كذلك للقوانين واللوائح المعمول بها داخل جمهورية مصر العربية.
Terms and Conditions for “Hand-to-Hand” Transactions via iSagha
1. Definition of the Transaction
• iSagha acts solely as an authorized intermediary and agent for both the seller and the buyer in executing transactions related to precious metals and jewelry.
• iSagha is not a direct party to the contract, nor does ownership of the goods or the payment ever pass to it. Its role is limited to mediation, verification, and ensuring that the transaction is carried out in accordance with Sharia principles and applicable laws.

2. Transaction Process
1. The buyer places a purchase order through the platform.
2. iSagha receives the payment from the buyer and receives the product from the seller, either at its premises or via approved shipping companies.
3. The iSagha team verifies the product’s specifications (purity, weight, official hallmark, or certificate of authenticity if available).
4. Once the product specifications are verified and the payment is confirmed, ownership of the product is transferred to the buyer, and the payment (after deducting the agreed service fees) is transferred to the seller.

3. Verification of Specifications
• Verification is carried out through visual inspection and weight measurement using certified calibration tools.
• Laboratory testing will only be conducted if agreed upon in advance.
• The verification conducted by iSagha is final and binding on both parties.

4. Delivery and Receipt
• Delivery may take place at iSagha’s premises or via approved shipping companies.
• If the buyer or seller chooses their own shipping provider, they bear full responsibility for any loss or damage.
• If delivery is arranged through a shipping partner contracted by iSagha, the platform will follow up on claims or compensation with the shipping company, without any direct financial liability unless gross negligence is proven.

5. Timeframe
• The transaction (verification, transfer of ownership, and transfer of funds) will be completed within 24–72 business hours from the receipt of both the product and the payment.

6. Service Fees and Commissions
• iSagha charges a predefined service fee or commission, deducted from the transaction value before transferring the funds to the seller.
• Both parties must review and agree to these fees prior to completing the transaction.

7. Refund Policy
• If the product is found not to match the agreed specifications, iSagha will retain both the product and the payment until the dispute is resolved.
• If the buyer withdraws before verification, the payment will be refunded after deducting an administrative fee.
• In all cases, iSagha bears no liability for disputes arising outside the scope of its direct verification process.

8. Dispute Resolution
• Any dispute will first be referred to iSagha’s internal committee within a maximum of 7 business days.
• If unresolved, the dispute shall fall under the jurisdiction of the courts of Cairo, Egypt, unless both parties agree to settle the matter through commercial arbitration.

9. Sharia and Legal Compliance
• iSagha affirms that all transactions are conducted in accordance with the principles of “hand-to-hand” sales under Islamic Sharia law, ensuring that ownership and payment are transferred simultaneously once conditions are met.
• These terms and conditions are also governed by the laws and regulations of the Arab Republic of Egypt.
